Membership Agreement & Terms of Use

Effective February 2026

1. The agreement

This agreement is between you and Zoë Anne & Co., LLC, a California limited liability company doing business as Agent & Co. (“we,” “us,” or “our”). By completing checkout or using the platform, you agree to these terms and to our Privacy Policy.

2. Membership and eligibility

Membership is by application and is intended for licensed real estate professionals. We may approve or decline any application at our discretion. Your account is for you alone — do not share login credentials or resell access.

3. What’s included

Active members receive weekly done-for-you content drops, AI listing tools, client reminders, monthly guides and workbooks, and monthly 1:1 strategy calls. Deliverables and features may evolve over time; we will not materially reduce the core membership without notice. Add-on services such as printed marketing materials and brand photo sessions are quoted and billed separately.

4. Billing, minimum term, and cancellation

  • Membership is $797 per month with a three-month minimum commitment, or $7,970 per year when billed annually. Prices are in U.S. dollars and exclude any applicable taxes.
  • Your subscription renews automatically each billing period using your payment method on file until you cancel.
  • You may cancel at any time after the minimum term from the billing portal in your dashboard. Cancellation takes effect at the end of the paid period and access continues until then.
  • Payments are non-refundable, including for partial periods and unused deliverables, except where required by law.
  • If a payment fails, we may retain access during a short grace period while we retry. Access may be suspended if payment is not resolved.

5. Your license to use the content

While your membership is active, we grant you a limited, non-exclusive, non-transferable license to use the templates, graphics, captions, and other materials we provide to market your own real estate business. You may not resell, redistribute, sublicense, or share membership materials with non-members, or present them as your own product or template library. Content you create with the platform’s AI tools is yours to use; you are responsible for reviewing it for accuracy and compliance before publishing.

6. Your responsibilities

You are responsible for complying with your brokerage’s policies, MLS rules, fair housing laws, advertising and licensing regulations, and the terms of any platform where you publish. You must include required disclosures and brokerage attribution. You agree not to upload unlawful content or content you do not have the rights to use.

7. AI-generated output

The platform uses AI to help draft marketing copy. AI output can be inaccurate or incomplete and is provided as a starting point. You must review and edit everything before use. We are not responsible for content you publish.

8. No performance guarantees

We do not guarantee leads, listings, sales, followers, engagement, or any specific business result. Nothing in the membership is legal, tax, or financial advice.

9. Disclaimers and limitation of liability

The platform is provided “as is” without warranties of any kind to the fullest extent permitted by law. To the maximum extent permitted by law, our total liability arising out of or relating to the membership will not exceed the amounts you paid us in the three months before the claim, and we will not be liable for indirect, incidental, or consequential damages.

10. Suspension and termination

We may suspend or terminate access for non-payment, abuse, or violation of these terms. If we terminate without cause, we will refund any prepaid, unused portion of your term.

11. Changes to these terms

We may update these terms. Material changes will be communicated by email or in the platform, and continued use after the effective date means you accept the updated terms.

12. Governing law

These terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute will be resolved in the state or federal courts located in California, and you consent to their jurisdiction.
